TERMS AND CONDITIONS

  1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. The Promoter is Visit Victoria Limited (ABN 37 611 725 270) of Level 28, 727 Collins Street, Melbourne VIC 3008, telephone: 03 9002 2276.
  3. Entry is only open to Australian residents aged 18 years or over.
  4. Employees (and their immediate families) of the Promoter, Victorian Government departments and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  5. Entries into the promotion open on 04/11/2018 and close at 11:59pm AEDT on 28/02/2019 (“Promotional Period”). All times referred to herein are AEDT, as applicable in VIC.
  6. To enter, individuals must visit www.frontrowmelbourne.com follow the prompts to the promotion entry page, input the requested details and submit the fully completed entry form during the Promotional Period.
  7. Only one (1) entry is permitted per person during the Promotional Period.
  8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  9. Incomplete or indecipherable entries will be deemed invalid.
  10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  11. There will be three (3) draws conducted for this promotion (each a “Monthly Draw”). Entries close for each Monthly Draw at 11:59pm on the dates specified in the table below. All draws will take place at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina NSW 2250 at 9:30am on the dates specified in the table below. All draws will take place in the presence of an independent scrutineer.  The Promoter may draw additional reserve entries in each Monthly Draw and record them in order in case an invalid entry or ineligible entrant is drawn. Un-drawn entries in each Monthly Draw will be entered into any subsequent Monthly Draw(s). Winners will be notified in writing within two (2) business days of the relevant draw their names will be published online at www.frontrowmelbourne.com from the dates specified in the table below.

  12. The Promoter’s decision is final and no correspondence will be entered into.

Monthly Draw 1 Prize

  1. The first valid entry drawn in Monthly Draw 1 will win a trip for four (4) adults to Melbourne to attend the 2019 Australian Open valued at up to $37,606 depending on point of departure. Prize includes:
    • Four (4) x return economy airfares from winner's nearest capital city to Melbourne, VIC (only provided if winner resides outside of VIC. If the winner is from VIC then the prize does not include airfares and the airfare component of the prize is not redeemable for cash);
    • Return transfers between airport and accommodation;
    • Two (2) nights twin share 5-star accommodation (2 x twin rooms) at the Crown Metropol;
    • Two (2) x super row seats and two (2) x on court seats at the 2019 Australian Open women’s final at Melbourne Park on Saturday 26/01/2019;
    • Four (4) x media accreditation passes which provides access to the post-match press conference;
    • A bespoke behind the scenes tour of Melbourne Park for four (4) (to be redeemed on Saturday 26/01/2019);
    • Four (4) x premium dining packages at Melbourne Park (to be redeemed on Saturday 26/01/2019);
    • Return transfers between accommodation and Australian Open at Melbourne Park;
    • Dinner for four (4) adults on set menu at GAZI on Sunday 27/01/2019 valued at up to $500; and
    • A beverage package valued at $500 for four (4) adults at Trinket on Sunday 27/01/2019.

Prize must be taken to coincide with the 2019 Australian Open women’s final event with the winner and his/her companions arriving on 26/01/2019 and departing on 28/01/2019, subject to booking and flight availability.

Monthly Draw 2 Prize

  1. The first valid entry drawn in Monthly Draw 2 will win a trip for four (4) adults to Melbourne to attend the 2019 Virgin Australia Melbourne Fashion Festival (“VAMFF”) and the 2019 Melbourne Food and Wine Festival valued at up to $17,050 depending on point of departure. Prize includes:
    • Four (4) x return economy airfares from winner's nearest capital city to Melbourne, VIC (only provided if winner resides outside of VIC. If the winner is from VIC, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash);
    • Return transfers between airport and accommodation;
    • Three (3) nights twin share 5-star accommodation (2 x twin rooms) at QT Melbourne;
    • Four (4) x VIP seats to Bank of Melbourne World's Longest Lunch on 08/03/2019;

    • A personal styling session and $1,500 shopping voucher (for the winner only) at VAMFF (date and time of styling session to be determined by the Promoter in agreement with the winner, but in the event that agreement cannot be reached, the Promoter reserves the right to determine the date and time the styling session will take place);
    • A bespoke behind-the-scenes tour of VAMFF Runway for four (4);
    • Return transfers between accommodation and VAMFF;
    • Four (4) x House of Food & Wine pass packages, inclusive hands-on workshop, on 09/03/2019; and
    • Lunch for four (4) adults on set menu at Supernormal on 10/03/2019 valued at up to $750.

Prize must be taken to coincide with the VAMFF and the 2019 Melbourne Food and Wine Festival events, with the winner and his/her companions arriving on 07/03/2019 and departing on 10/03/2019, subject to booking and flight availability. Any ancillary costs associated with redeeming the voucher are not included. Any unused balance of the voucher will not be awarded as cash. Redemption of the voucher is subject to any terms and conditions of the issuer including those specified on the voucher.

Monthly Draw 3 Prize

  1. The first valid entry drawn in Monthly Draw 3 will win a trip for four (4) adults to Melbourne to attend the 2019 Formula 1 Australian Grand Prix valued at up to $21,580 depending on point of departure. Prize includes:
    • Four (4) x return economy airfares from winner's nearest capital city to Melbourne, VIC (only provided if winner resides outside of VIC. If the winner is from VIC, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash);
    • Return transfers between airport and accommodation;
    • Three (3) nights twin share 5-star accommodation (2 x twin rooms) at the Blackman Hotel, St Kilda;
    • Four (4) x VIP passes to Glamour on the Grid on 14/03/2019;
    • Return transfers between accommodation and Glamour on the Grid;
    • Four (4) x three-day tickets to Parc Chalet;
    • A garage tour of a Formula 1 team for four (4) adults (with the exact team to be determined by the Promoter in its discretion);
    • A “Meet & Greet” with a Formula 1 driver (with the exact driver to be determined by the Promoter in its discretion); and  
    • Hot Lap of F1® Circuit for winner only (height and weight restrictions apply – see below).

    Prize must be taken to coincide with the 2019 Formula 1 Australian Grand Prix event with the winner and his/her companions arriving on 14/03/2019 and departing on 17/03/2019, subject to booking and flight availability. In order to participate in the Hot Lap of F1® Circuit, the winner must be within the following height, weight and body dimension restrictions:

    • Maximum height: 1.83m (6 foot);
    • Minimum height: 1.58m (5 foot 2 inches);
    • Maximum weight: 88kg (14 stone); and
    • Maximum girth (including upper arms): 139.7cm (55 inches).

General

  1. Spending money, meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included in any prize. Winners and their companions must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of any prize. Prizes are subject to the standard terms and conditions of individual prize and service providers. Winners may be required to present their credit card at time of accommodation check in.
  2. Subject to the unclaimed prize draw clause, if for any reason a winner does not take / redeem a prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
  3. If any prize (or part of the/any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  4. The ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the/any winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
  5. The “Meet & Greet” awarded as part of Monthly Draw 3 provides the winner (and his/her companions) with an opportunity to meet a Formula 1 driver. This element of the prize is not guaranteed and is subject to the goodwill of the Formula 1 driver on the day. The Promoter accepts no responsibility and will not offer any alternative in the event that this element of the prize cannot be offered for any reason.
  6. The winner of the Hot Lap of F1® Circuit prize (the “Activity”) acknowledges that the Activity is a dangerous activity that may result in injury or death and participate at their own risk. The winner must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Activity organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Activity; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the Promoter and Activity organisers at all times; and (e) wear all safety and other equipment required. The Promoter and Activity organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any winner from participating in the Activity if, at any time, they reasonably believe that the winner poses a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. If the Activity is varied for any reason beyond the control of the Promoter, it may not be rescheduled and no compensation will be offered.
  7. Total prize pool value is up to $76,236.  
  8. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
  9. A draw for any unclaimed prizes may take place on the dates specified in the table below at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the relevant draw and their names will be published online at www.frontrowmelbourne.com from the dates specified in the table below.

  1. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  2. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  3. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  4. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  5. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if any event that forms part of a prize is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) participation in a prize / attendance at a prize event.
  6. As a condition of accepting the prize, the winners (and their companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  7. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, sponsors, government departments or agencies, media partners, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://corporate.visitvictoria.com/legal-notices/. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter may disclose PI to entities outside of Australia.
  8. The Promoter may also disclose PI to selected sponsors and media partners, if an entrant consents to such disclosure at the time of entry, who may use the information for their own marketing purposes. For details on how PI will be handled by such sponsors and media partners, entrants should view their privacy policy (which will be made available at the time of entry, where applicable).
